An important part of our job is to check the property you wish to buy to make sure everything is 100% legally compliant and all the necessary documents are in place. Our legal team will perform the following activities for you (included in our standard fees):

  • Drafting a power of attorney to represent the client in Italy if requested
  • Italian fiscal code request on behalf of the client
  • Drafting a preliminary contract (or a proposal) and its registration with the tax authority office
  • Due diligence concerning the legal status of the property including verification of the:
  • Town planning conformity;
  • Certificate of habitability – specifying that the property respects the safety, health and energy conditions imposed by the Italian legislation;
  • Pre-emptive rights – applicable to historic real estate properties;
  • Pre-emptive rights of neighbouring farmers in case of land purchase;
  • Encumbrances, easements and third-party rights over the property;
  • Condominium aspects – stipulating the rights and obligations of the owner in terms of common spaces of the building;
  • Title deed.
  • Tax planning of the real estate transaction
  • Revision of the wording of the Notarial deed of sale/purchase and assistance of the client during its stipulation
  • Legal advice on the residency options both for EU and non-EU citizens

If desired, we can also provide the following services:

  • Opening a bank account through a power of attorney
  • Drafting a contract for the sale of furniture to avoid additional registration tax
  • Technical legal due diligence aimed at verifying the stability of the building structure
  • Translation and legalization of documents (fees are per “translation” page)
  • Providing a professional interpreter (fees are per hour)
  • Legal advice on conversion of a foreign driving license
  • Incorporation of a company under Italian law and tax planning
  • Drafting of cross-border wills
  • Any of these additional services will be quoted and charged separately.
